Introduction

These Terms & Conditions ("Terms") form a legally binding agreement between you ("User," "Sender," "Traveler," "Recipient," "You") and Shared Luggage Technologies Inc. ("Shared Luggage," "We," "Us," "Our").
By creating an account, accessing, or using sharedluggage.com (the "Platform"), you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Platform.

1. About Shared Luggage

Shared Luggage is a peer-to-peer crowdshipping marketplace connecting:
Senders who want to send personal items, and
Travelers who have extra luggage space on their trips.
Shared Luggage does not transport items, does not act as a courier, freight forwarder, broker, carrier, or customs agent. All shipping is performed directly by Travelers, at their sole responsibility and risk.
Shared Luggage collects a platform commission when a shipment is successfully completed.

2. Eligibility & User Accounts

To use the Platform, you must:
• Be at least 18 years old
• Provide accurate, truthful account information
• Maintain a valid email address
• Follow all applicable laws, customs rules, and these Terms
Shared Luggage may require users to undergo identity verification (photo ID, phone verification, address confirmation, liveliness check, etc.) and may request additional documentation.
Shared Luggage may suspend or terminate accounts without notice if inaccurate or fraudulent information is suspected.

3. Personal Items Only (No Commercial Shipments)

All shipments arranged through Shared Luggage must be strictly personal, non-commercial items.
Commercial goods, items for resale, business shipments, and bulk goods are strictly prohibited.
Travelers and Senders must confirm that all items:
• Are owned legally and personally
• Are not intended for commercial, industrial, institutional, or resale use
• Do not require export permits
• Are not subject to customs declarations that classify them as commercial goods

4. Strictly Prohibited Items

The following cannot be shipped under any circumstances:
A. Export-Controlled or Restricted Items (by Canada or Destination Country)
• Items on Canada's Export Control List
• Items destined for any country on the Area Control List
• Any item requiring an export/import permit
• Controlled nuclear, military, dual-use, encryption, or strategic goods
• Any item requiring reporting under the Customs Act
B. Illegal or Dangerous Items
• Weapons, firearms, replicas, ammunition
• Drugs, narcotics, cannabis (legal or illegal), drug paraphernalia
• Explosives, flammables, hazardous materials
• Human remains, blood, bodily fluids
• Perishables requiring refrigeration
• Stolen goods or counterfeit products
C. High-Risk Items
• Cash, cheques, money orders
• Precious metals, jewelry, gems
• Electronics of suspicious origin
• Passports, government IDs
• Confidential documents, credit cards
• Animals, plants, biological items
D. Any Item Prohibited by:
• The airline or travel carrier
• Airport or TSA-equivalent security
• Canadian customs
• Destination country customs
Shared Luggage may update prohibited items at any time.

5. User Responsibilities

Senders must:
• Provide a truthful, accurate description of the item
• Ensure the item complies with all laws and prohibitions
• Provide proper packaging
• Provide correct contact details for recipient
• Not hide, mislabel, or misrepresent items
Travelers must:
• Inspect items before accepting
• Comply with airline baggage rules
• Declare items honestly to customs agents when required
• Ensure the safe delivery of the item
• Not transport items they do not understand or trust
Both parties agree to:
• Communicate honestly through the Platform
• Not circumvent the Platform for payments
• Not engage in fraud, scams, or illegal activity

6. Platform Fees & Payments

Payment services are provided by Trustap.com ("Trustap") and include Trustap Buyer Protection. Shared Luggage does not hold user funds directly.
By accessing or using Trustap's payment services on Shared Luggage, you acknowledge and agree that:
• You are entering into a direct relationship with Trustap for the use of Trustap's payment services
• Your use of Trustap's payment services is governed by Trustap's Terms of Service, Privacy Policy, and any other applicable policies, which you accept and agree to comply with
• Any updates or modifications made by Trustap to its Terms of Service shall automatically apply to your use of Trustap's payment services on Shared Luggage without further notice from us
• Dispute investigations and outcome decisions are managed by Shared Luggage
Payment Process:
• Senders pay upfront
• Funds are held in escrow by Trustap
• Travelers are paid out after successful delivery
• Shared Luggage receives its commission post-completion
• If no match occurs within 90 days, the payment is refunded to Sender
Shared Luggage is not responsible for delays, refunds, or reversals initiated by payment processors.

7. Customs, Border & Airline Compliance

Travelers and Senders are solely responsible for compliance with:
• Canada Border Services Agency (CBSA)
• Destination customs authorities
• Airline baggage regulations
• Export/import documentation and declarations
Shared Luggage does not:
• Provide customs clearance advice
• Provide export/import documentation
• Act as a customs broker or agent
Travelers carry items at their own risk, and Senders ship items at their own risk.
If customs seizes, delays, destroys, fines, or inspects an item:
• Shared Luggage is not liable
• No refunds are guaranteed
• Users may face legal consequences

8. Liability Disclaimer

You use Shared Luggage at your own risk.
Shared Luggage is not responsible for:
• Loss, damage, theft, or delay of items
• Airline loss or mishandling of luggage
• Customs seizure or penalties
• Traveler no-shows or Sender misrepresentation
• Fraud or illegal activity by users
• Miscommunication, missed deliveries, or address errors
Maximum liability of Shared Luggage is limited to the total commission earned for that specific transaction, and only if legally required.
Travelers and Senders must resolve item-related disputes directly through the Platform or Trustap.

9. Indemnification

You agree to indemnify and hold harmless Shared Luggage, its directors, employees, and agents from any claims, damages, losses, penalties, legal fees, or liabilities arising from:
• Illegal items
• Breach of these Terms
• Misrepresentation of shipments
• Customs or border violations
• Loss or damage caused by your acts
This clause survives account termination.

10. Account Suspension and Termination

Shared Luggage may suspend or terminate accounts immediately if users:
• Ship prohibited items
• Misrepresent goods
• Attempt to bypass payments
• Fail identity verification
• Engage in suspicious or illegal activity
• Abuse the Platform or other users
Shared Luggage is not required to provide notice or explanation.

11. Intellectual Property

All content on sharedluggage.com is owned by Shared Luggage. Users may not reproduce, copy, modify, or exploit the Platform or its content.

12. Modification of Terms

Shared Luggage may update these Terms at any time. Users will be notified, and continued use of the Platform constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of:
• The Province of Saskatchewan, and
• The federal laws of Canada applicable therein
Legal disputes must be brought before the courts of Saskatchewan.
